Copyright is one of the subjects upon which Democrats and Republicans can get together. Democrats emphasize their love of art and artists. Republicans emphasize their love of Locke-style private property. This bipartisan law has three sections.
Music Modernization Act
The first section is Music Licensing Modernization. This is a new blanket license for digital music providers to engage in permanent downloads, limited downloads, and interactive streaming. It establishes a market-oriented “willing buyer, willing seller” rate standard for all licenses under Section 115 of the Copyright Act.
The second section is Classics Protection and Access. This enhances remedies for infringement of sound recordings from before 1972. The third section, Allocation for Music Producers, allows music producers to receive compensation from royalties collected for certain uses of sound recordings.
