A. Fashion Law Institute Pop Up Clinic
In the dreary days of late January was a shining light of optimism: a Pop-up Clinic from Fordham Law School’s Fashion Law Institute (the “FLI”). Created with support from the Council of Fashion Designers of America and its president, Diane von Furstenberg, the FLI is directed by the progenitor and pioneer of fashion law herself, Susan Scafidi. Not even a global pandemic or “uncertain times” can stop FLI from pursuing its mission to train fashion lawyers. I was honored to serve as one of the senior attorneys during this clinic, supported by law student Alex Machado, who was of great help in researching the nuances of clearance for a prospective trademark, as well as trademarking one’s name.
B. Panel on Amendments to New York’s Right of Publicity Bill
As co-chair of the New York State Bar’s committee on Publicity, Privacy, and Media Law, I moderated a panel on February 22, 2021 called, Stealing Your Image and the Grateful Dead: Amendments to the NY Right of Publicity Law. The panel was divided into three subjects:
(1) New Yorkers’ new post-mortem right of publicity that lasts 40 years after life which must be properly registered by an heir within a certain amount of time;
(2) Restrictions against the unauthorized use of “deep fakes” of dead celebrities; and
(3) Bolstered restrictions on unauthorized use of one’s image in intimate settings, including “revenge porn.”
